Frequently Asked Questions
You don’t have to. In fact, we let you know on our website how to get your money back yourself which will mean every penny you get back is yours.
We're here for the people who don’t have the time to claim themselves, or for people who want our expertise. We're made up of former financial services professionals who've worked at banks, regulators and the Consumer Financial Protection Bureau (CFPB) so we know the process and your rights inside out.
Unfortunately this varies widely depending on your case and whether your bank agrees to refund you or if we have to take the case further.
Sometimes it can be extremely quick, with many customers receiving an outcome within 15 days of our complaint (the time your bank has to respond).
However, if your bank rejects your complaint and we have to take it to the Consumer Financial Protection Bureau (CFPB) it can take as long as a few years (in extreme cases) for FOS to deal with your case. We'll keep you updated along the way.
It’s great to be wary and we would encourage everyone to familiarise themself with the information that we have on Recovery Scams as it’s common to be targeted by a secondary scam.
1. Check the CFPB Register (Registration number: 937096)

SCAMFISH will never reach out to you out of the blue or ask for money upfront. If someone reaches out in this way then please email us at enquires@scamfish.org
If a scammer took out credit and the bank is trying to make you repay it, we're happy to try and resolve this with your bank for free as part of our service.
However, if you choose to use a refund you receive for money you lost to pay off debt, our fee is still payable.
Any refund given to you by the bank of money you lost to fraud is not subject to tax. If the bank issues compensation, you're required to pay tax on that element. Normally the bank will deduct the tax (at 20%) from the compensation before paying you.
If you're not a taxpayer you might be able to claim this back from HMRC. You'll need to contact them directly in order to complete an R40 claim form.
Tax liability as a result of any compensation award is your responsibility and not something we get involved with.
In short, probably. Our most common scam types involve cryptocurrency so as long as the money started in a US bank account then we should be able to help.
Your fraud claim with us can be cancelled at any time with no charge for the services you’ve received. However, if you cancel after we’ve started work on your case, and an offer is made, redress is received or you become aware that your case is going to be successful, our usual fees apply.
To cancel you can contact us through your SCAMFISH contact or email us at enquires@scamfish.org.

Yes, as long as the money was sent from a US bank account, we can usually help regardless of where you live. The key factor is the US banking element — contact us to discuss your specific situation.
If successful, the bank will typically refund the money directly into your original account (or the account you specify). We’ll guide you through the process and ensure the refund is handled correctly.
In many cases, we can still help. If you win a refund, it may be treated as a separate asset depending on your arrangement type. We’ll advise you fully and coordinate with your insolvency practitioner or trustee where required.
You can cancel at any time with no charge for services received so far. If you cancel after we’ve started work and an offer/redress is made or your case looks successful, our usual fees may apply. Contact us or email enquires@scamfish.org to cancel.
No. Claiming fraud does not affect your normal banking relationship. Banks are required by regulation to handle fraud complaints fairly and cannot penalize you for making a legitimate claim.
Yes — in many cases we can still help. Even if the bank wasn't directly at fault, they have a duty to protect customers from fraud under regulations. We’ll assess whether they failed in their responsibilities.
Yes — if the money originated from a US bank account before being converted to crypto, we can usually help. The key is the US banking element. Contact us to discuss your case.
Any refund of money lost to fraud is not taxable. Compensation (extra goodwill payment) may be taxable, but banks usually deduct tax at source. If you're not a taxpayer, you can reclaim it from HMRC using an R40 form. Tax is your responsibility — we don’t advise on it.
No — if the bank wrote off debt caused by fraud, we consider that part of your recovery and our fee applies to it (as you no longer owe that amount). We’ll explain fully before proceeding.
It depends on your case details (how the scam happened, what evidence exists, bank response, etc.). We only take cases we believe have a strong chance of success. Many of our clients recover significant amounts — but no one can guarantee 100%.
